1. Acceptance of Terms
By creating an account or using TNT Platforms ("the Platform," "we," "us," or "our"), you ("User," "Contractor") agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Platform.
2. Description of Service
TNT Platforms is a SaaS contractor management platform providing tools including but not limited to: job estimating, expense tracking, invoicing, scheduling, financial reporting, and business management features. The Platform is intended for use by licensed painting and general contractors and is fully functional and actively maintained, with new features being released on an ongoing basis.
3. Eligibility
You must be at least 18 years of age and legally authorized to operate a contracting business in your jurisdiction. By using the Platform you represent and warrant that you meet these requirements.
4. Account Registration
• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at johnturri@tntpainting530.com if you suspect unauthorized access.
• We reserve the right to suspend or terminate accounts that provide false information.
5. Early Access Pricing & Subscription Plans
TNT Platforms is currently in Early Access. Early Access users receive a discounted rate for their first 2 billing months as displayed at signup. After the Early Access discount period, subscriptions automatically renew at the standard rate. Standard subscription plans are: Field ($29/mo), Foreman ($59/mo), General ($99/mo). Prices are subject to change with 30 days written notice. Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method on file for recurring subscription fees. Discount codes cannot be combined with Early Access pricing unless explicitly stated.
6. Cancellation & Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. You retain full access until the end of the paid period. We do not offer refunds for partial billing periods. Comped or free accounts granted by platform administration are non-transferable and may be revoked at any time. Early Access pricing is non-refundable once the discount period has been applied.
7. Contractor Data & Privacy
TNT Platforms does not access, view, share, or sell your customer data, job site photos, client information, or estimate details. Your business data is your property. We act solely as a technology service provider. You retain full ownership of all data you input into the Platform.
8. License Verification
TNT Platforms may verify contractor license numbers through state licensing databases. A verified badge does not constitute our endorsement or guarantee of your licensing status. You are solely responsible for maintaining a valid contractor's license in your jurisdiction. Providing a false or expired license number is grounds for immediate account termination.
9. Acceptable Use
You agree NOT to: use the Platform for any unlawful purpose; impersonate another person or business; attempt to gain unauthorized access to the Platform or other user accounts; reverse engineer, decompile, or disassemble any part of the Platform; use the Platform to transmit spam, malware, or harmful content; or resell or sublicense access to the Platform without written consent.
10. Estimates & Financial Tools
All estimates generated by the Platform are tools to assist contractors and are NOT guaranteed quotes. Final pricing is the sole responsibility of the contractor. TNT Platforms is not liable for any disputes between contractors and their clients regarding pricing, scope of work, or payment. Financial reports and P&L data are based solely on information you input. We make no representations regarding their accuracy or completeness.
11. Platform Development & Changes
During Early Access, features may be added, updated, or modified at any time. We will make reasonable efforts to notify users of significant changes via email or in-app notification. Planned maintenance or downtime will be communicated in advance when possible. We are not liable for any losses resulting from platform updates, feature changes, or temporary downtime.
12. Intellectual Property
The TNT Platforms name, logo, software, and all platform content are the intellectual property of Johnathan Turri / TNT Platforms. You may not reproduce, distribute, or create derivative works without written permission. You retain ownership of all content and data you upload or input.
13. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." WHILE TNT PLATFORMS IS FULLY OPERATIONAL, WE MAKE NO WARRANTIES REGARDING UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, OR FITNESS FOR ANY PARTICULAR PURPOSE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TNT PLATFORMS AND JOHNATHAN TURRI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify and hold harmless Johnathan Turri, TNT Platforms, and any affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
16. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason at our sole discretion. You may terminate your account at any time by contacting us or using the account deletion feature.
17. Governing Law
These Terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the courts of Butte County, California.
18. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users via email or in-app notification at least 14 days before material changes take effect. Continued use of the Platform after changes constitutes acceptance.
